These Terms of Service (this “Agreement”) between LogoPoppin (“we”, “us” or “LogoPoppin”) and you govern your access and use of our graphic design platform made available through www.logopoppin.com (this “Site”) and the subscription or other services we provide (the “Services”). By using this Site and accessing our Services in any manner, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

We may update this Agreement from time to time. By continuing to use this Site and the Services after the update, you accept the update in its entirety. All updates are effective upon posting.

Privacy Policy

Our privacy policy, which can be found at https://logopoppin.com/privacy-policy (the “Privacy Policy”), describes how we may use your personal information. By continuing to use this Site, you accept the Privacy Policy, which is incorporated herein by reference. If you object to your personal information being used as described in the Privacy Policy, please leave this Site immediately. You must be at least age 18 to access this Site.

Electronic Communications

We only contact our clients from the email address or contact number provided on our website. Therefore, we don’t take responsibility for the damage caused by emails or contact numbers not mentioned on our website.

The moment the client visits our site or sends e-mails to our contacts, the client is communicating with our company electronically. Our Company will communicate with the client by e-mail or by posting notices on this site. Thus the client agrees that all agreements, notices, disclosures, and relevant communication satisfy and fulfill all legal requirements and are equivalent to any legal statement in writing.

Site Contents Usage

The choice of visiting our Homepage is solely your decision. Any dispute over privacy is subject to this Notice and our Conditions of Use. This includes limitations on damages, arbitration of disputes, and the applicable law of the state. If the client has any issues regarding the Privacy Policy, they should contact us at their best convenience. Our customer services shall be most happy to serve the clients. As our Policies are liable to change at any time, it is recommended that the client goes through the policy each time they enter the site to purchase.

The company gathers navigational information about where visitors go on our website and information about the technical efficiencies of our website and service (i.e. time to connect and time to download pages). This information allows us to see which areas of our Company’s Website are most visited and helps us understand our clients better than before. This also helps us improve the quality of those sites which are lacking in some way or the other. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, written and other materials that are part of this Site (collectively, the “Contents”) are copyrights, trademarks, trade dress, and/or other intellectual property owned, controlled or licensed by the Company.

This Site and all its Contents are intended solely for personal and non-commercial use. The client may download or copy the Contents and other downloadable materials displayed on the Site for their personal use only. No right, title, or interest in any downloaded materials or software is transferred to the client as a result of any such downloading or copying. The client may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivatives, sell or participate in any sale or exploitation of the site, its content, or any related software.

Portfolio Rights

You hereby grant us a limited, non-exclusive, non-sublicensable, royalty-free worldwide license to use, publish, and display any deliverables that we develop in connection with the services for the purpose of marketing and advertising (the “Portfolio Rights License”). You may revoke the Portfolio Rights License at any time by sending written notice to support@logopoppin.com. If you revoke the Portfolio Rights License, we will stop using your deliverables for marketing and advertising purposes, however, your deliverables may continue to exist elsewhere online such as where the deliverables have been used by others in accordance with the Portfolio Rights License.

Attribution

We may display attribution text or links in your website footer or toolbar, noting that your website is Designed & Developed by LogoPoppin. For any concerns regarding this attribution, you may submit your request at support@logopoppin.com.

Testimonials

All comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted, or offered to Our Company on or by this Site or otherwise disclosed, submitted, or offered in connection with your use of this Site (collectively, the “Comments”) shall remain the Company’s property.

The Company will own exclusive rights, titles, and interests and shall not be limited in any way in its use, commercial or otherwise, with reference to the Comments. The Company is and shall be under no obligation:

  • To maintain any Comments in confidence
  • To pay to user any compensation for any Comments or
  • To respond to any user Comments.

The company can also use the testimonials and logos of the clients on its other web and offline properties.

All content that is included on this site, such as text, graphics, logos, button icons, images, digital downloads, data compilations, and software, is the property of this company or its content suppliers and protected by AUS and international copyright laws. All software used at this site is the property of this company or its software suppliers and protected by AUS and international copyright laws. The trademark names used within our sites are the property of their respective company or its subsidiaries and can not be used in connection with any product or service that is not part of that company.

Copyright Complaints

The Company and its affiliates respect the intellectual property of others. If anyone browsing the site believes that their work has been copied in a way that constitutes copyright infringement, kindly email us your concern and our team will assist you further.

Our Policy to Access Information

LogoPoppin may ask for certain information once you decide to access our services. For example, you may need to provide registration details or other information. After accepting these terms and conditions, you acknowledge that the information you’ve provided is correct, accurate, and complete.

We reserve the right to refuse your access to our services or resources if the information provided by you turns out to be false, incorrect, or incomplete. We also reserve the right to terminate or suspend your account at any time over providing misinformation.

Consumer Data Safety Measures

We respect your right to privacy. We, therefore, do not share your name and contact details with any third party. Besides, we keep information provided by you confidential. The information you provide is used only to understand your requirements and to improve our services to suit your needs rather effectively. We ensure to follow the standards set by PCI and consumer data protection.

It is hereby declared that our company does not authorize its representatives to collect any confidential information from our customers i.e. credit card information etc. Accordingly, we advise our customers not to share any confidential and sensitive nature information with our employees. If you do so; you shall be doing it at your own risk and our company shall not be liable for any misuse.

Delivery Policy

Projects are delivered to the clients as per their requirements within the order confirmation timeline. An email is sent to inform clients about project delivery. The time frame and cost of project delivery vary according to the project and package selected by clients. In general, most projects are initiated within 24 to 48 hours or vary according to the project’s urgency or package selected.

Revision Policy

Revisions will be done according to the package you select. In case of any new revisions, additional charges may be applicable as per the current charges. Revision turnaround time would approximately be 2-3 Business days.

Refund policy

Deposited funds will not be refunded after project delivery, especially if you’ve approved the initial design concepts or requested a change or revision in the initial concepts sent over. In addition, LogoPoppin reserves the right to cancel or terminate your contract in the case of a breach, nonperformance, or other reason.

The Process to Request a Refund

You can ask for a refund after receiving the initial concept for a logo. However, the refund will not be entertained once you approve or ask for changes in the initial designs. If you ask for a refund before receiving the initial design concepts, you will get a Full Refund (a 10% service & processing fee will be deducted). You would be eligible for 66% of the refund if you request it within 48 hours (10% service & processing fee will be deducted) of receiving the initial concept. You would be eligible for 33% of the refund if you request it within 48-120 hours of initial delivery (10% service & processing fee will be deducted). You cannot request a refund after 120 hours of the initial project delivery. However, we value our esteemed customers and encourage them to consult with us in the case of any concern. You cannot request a refund if no action has been taken on an order within 30 days after placing it or after 30 days of inactivation or non-responsiveness from the client’s side. However, we welcome you to reactivate your design order any time after submitting a certain fee, depending on the project. We will not entertain a refund once we’ve delivered the final files. You cannot ask for a refund on a website package once the website design is approved. You cannot ask for a refund on a video animation package once the design of a storyboard gets completed. Our support department is available to discuss refund requests. In the case of user agreement violation, LogoPoppin reserves the right to approve or disapprove your request.

Refund on the custom package is similar to the single packages.

If you’ve ordered a logo and website and approved the logo design only, you will be eligible to claim a refund for the website while it’s in the initial design level and the design has not been shared or approved yet.

A request for a refund should be based on a valid reason. It needs to be qualified against the design’s brief or customer’s feedback for revisions. You can claim a refund if a design hasn’t been made as per the brief and no revision has been requested. You can always ask for revisions to the design to meet satisfaction.

Since design projects require the client’s feedback, we encourage our clientele to get involved in the design process to achieve the desired results.

We offer 100% unique designs. Kindly note that any resemblance will be a coincidence, and we won’t be responsible or offer compensation. As a client, it’s your responsibility to get the artwork copyrighted.

How to Request a Refund?

You need to meet the requirements to get your refund request approved.

Contact us using the following modes to ask for a refund:

Email us at support@logopoppin.com with the refund request along with a reason.

We will resolve your concern following our refund policy, or our refund department will send you an email confirming your refund request. However, LogoPoppin will obtain complete design rights and therefore, you won’t be allowed to display any version of the designs.

Here’s what it means:
The design and all work rights would be transferred to LogoPoppin, and you would agree that you have no direct or indirect rights to use or own the content, work product, or media.

Working in collaboration with the Government Copyright Agencies, we would share Copyright Acquisition information for the refunded design. This way, we would restrict you from reusing the designs in the future. In the case of any query, you can consider our refund policy or contact us at support@logopoppin.com.

Our Quality Assurance Policy

We begin a design project after conducting extensive research, ensuring the design quality and uniqueness. To assure the desired satisfaction, our designers strictly adhere to the specifications provided in the order form.

Our Customer Support Service

Our Customer Support Service is available 9-5 Mon-Fri EST to address clients’ queries and questions.

Exclusions

LogoPoppin assists clientele with the integration of APIs and 3rd party plugins. The required integration to assist the website’s functionality will be standard. We don’t deal with the third party during project development. In the case of additional work, we require a separate fee agreement.
